Terms of service

These terms are an agreement between you and ForwardStack LLC ("ForwardStack", "we", "us"), the company that runs MissionC3, a volunteer and community management service for nonprofit organizations. They apply to missionc3.app, every organization's MissionC3 site, our apps, and the texts and emails MissionC3 sends. By using MissionC3 you agree to them and to our privacy policy.

1. Who may use MissionC3

• You must be at least 13 years old to create a sign-in.
• If you set up MissionC3 for an organization, you confirm you're allowed to accept these terms for it. "Organization" below means that customer; "you" means the person using MissionC3, and the organization where the terms say so.

2. Your sign-in

Keep your password and sign-in links private, and tell us at support@forwardstack.io if you think someone else has used your account. You're responsible for what happens under your sign-in.

3. Organizations' responsibilities

• The organization owns the records it keeps in MissionC3 and decides what it collects. It's responsible for having the right to collect and use that information, for its own privacy notice to its people, and for what its staff do in MissionC3.
• The organization texts and emails only people who have agreed to receive them where the law or the carriers require it, and honors every request to stop.
• The organization gives us permission to store, process and send its information only as needed to provide MissionC3 and as our privacy policy describes.
• The organization can export its records while its account is open, and for a reasonable period after it closes.

4. Text messages

MissionC3 sends texts from an organization (in its name) or from MissionC3 itself (support requests, service outages and account updates), only to people who have agreed to them.

• Agreeing: you agree by ticking an unticked checkbox on a sign-up form or in your settings. Agreeing is never required to take part. After you agree, you'll get one text confirming it.
• How often: message frequency varies.
• Cost: message and data rates may apply.
• To stop: reply STOP to any text. You'll get one message confirming it, and no more. Reply START to get texts again.
• For help: reply HELP, or contact the organization, or us at support@forwardstack.io.
• Carriers aren't liable for delayed or undelivered messages.
• Each organization's texting terms are at its MissionC3 address/messaging-terms. Our privacy policy explains how your number is used. We do not sell or share your SMS opt-in data or personal information with third parties for marketing purposes.

5. Acceptable use

Don't use MissionC3 to:

• send spam or messages to people who haven't agreed to them, or break any law, including anti-spam and texting laws;
• harass, threaten or discriminate against anyone, or share content you don't have the right to share;
• upload malware, probe or break MissionC3's security, or reach another organization's information;
• overload the service, scrape it, or copy, resell or reverse-engineer it.

We may remove content or suspend access that breaks these rules.

6. Fees

Organizations pay the fees for the plan they choose, plus any taxes. Fees are non-refundable except where the law requires otherwise. We'll give notice before changing an organization's fees. If fees go unpaid, we may suspend the organization's account after telling it.

7. Our service

• MissionC3, its software and its design belong to ForwardStack. We give you permission to use it under these terms; nothing else transfers.
• We improve MissionC3 over time and may change or remove features. We'll give notice of changes that significantly affect organizations.
• If you send us suggestions, we may use them without owing you anything.

8. Ending

An organization may close its account at any time. We may suspend or end access for a serious or repeated breach of these terms, or where the law requires, and we'll give notice when we reasonably can.

9. Disclaimers

MissionC3 is provided "as is" and "as available". We work to keep it running and secure, but to the extent the law allows, we make no other promises, including that it will be uninterrupted or error-free, or fit for a particular purpose. MissionC3 is not an emergency service: don't rely on it as the only way to reach people in an emergency.

10. Limit of liability

To the extent the law allows, ForwardStack isn't liable for indirect, incidental, special or consequential damages, or for lost profits, data or goodwill, and our total liability for any claim about MissionC3 is limited to the fees the organization paid us in the 12 months before the claim.

11. Indemnity

The organization will defend and compensate ForwardStack for claims arising from its information, its messages, or its or its staff's breach of these terms or of the law.

12. Law and disputes

These terms are governed by the laws of the State of Wisconsin, without regard to its conflict-of-law rules. Disputes will be decided in the state or federal courts in Dane County, Wisconsin.

13. Changes to these terms

We'll post any change here with a new "Last updated" date, and tell organizations before a significant change takes effect. Using MissionC3 after that means you accept the change.
